Outsource2day is an online platform that enables Businesses (Buyers) and Service Providers/ Freelancers (Sellers) to connect.
Outsource2day offers Services based on hourly rates or fixed project rates. These are collectively referred to in these terms as “Project”. It is at the discretion of both Seller/Buyer whether a Project is offered/accepted.
Services are provided by Sellers directly to Buyers where both parties determine the price, delivery timeframe and all other requirements associated with completing the Project. Outsource2day acts as a platform to facilitate this process only & takes no responsibility for the agreed terms between a Buyer and Seller.
Once the Project has been awarded by Buyer to Seller, the Seller must inform Outsource2day by email to firstname.lastname@example.org of terms agreed in relation to price, delivery timeframe and stage payments agreed.
Outsource2day will contact the Buyer on behalf of the Seller requesting that funds are transferred into a designated holding account. Funds will only be released by Outsource2day on behalf of Buyer to Seller in accordance with the terms agreed and upon receipt of approval from Buyer.
Outsource2day will inform Seller when funds have been transferred so they can commence work on the Project.
Seller to communicate with Buyer directly from hereon in outside the realm of Outsource2day.
Sellers must deliver work within the delivery times agreed with the Buyer as agreed in terms agreed. Sellers must complete their Projects and Buyers agree to pay for work delivered.
Sellers must not request payment upfront from Outsource2day. Buyers must pay within the 5day payment terms.
Where stage payments have been agreed between Seller & Buyer, the Seller must inform Outsource2day that a stage payment is due. Prior to releasing funds, Outsource2day will request confirmation from Buyer that funds can be released to Seller for the value agreed.
Upon receipt of confirmation that funds can be released, Outsource2day will transfer the funds directly into the bank account of the Seller minus commission & Vat based on total value of Project.
Once the Project has been completed and final payment has been released by Outsource2day on behalf of Buyer, Outsource2day will raise an invoice on behalf of Seller to Buyer showing all payments received.
Where a Buyer is dissatisfied with the works delivered, the Seller must be given an opportunity by the Buyer to provide at least two further amendments on the work delivered if the Buyer is not initially satisfied. Users will be penalised for cancellations or refunds caused by them without just reason.
Should Buyer refuse to authorise Outsource2day to release funds to Seller, the Buyer must provide reason for their decision to Outsource2day. This information is then passed to Seller who is responsible for engaging directly with Buyer to find a resolution. As the service contract is between the Seller and Buyer, Outsource2day is in no way to be held responsible for issues that may arise between both parties.
If no resolution found, Outsource2day will refund all monies held in holding account paid by the Buyer in relation to said Project less funds already paid over to Seller having previously been authorised by Buyer.
All payments for Projects agreed must go via Outsource2day. Where an offer is made to pay outside of Outsource2day by either Buyer or Seller this must be reported to Outsource2day immediately.
Attempts to pay outside of Outsource2day will lead to immediate account suspension.
Once payment has been made by the Buyer and received by the Seller, the Buyer is granted all rights for the delivered work.
For purposes of service messages, notices, offers and news about Outsource2day, Users receive alerts on certain pages and emails to the email addresses associated with their accounts. Users can easily unsubscribe from any email notification using an unsubscribe link found at the end of any email as well as their Settings page.
To access the full Outsource2day site, Users must register for an account, provide accurate and complete information, and keep their account information updated. Both Buyers and Sellers undergo the same account registration process. Outsource2day reserves the right to refuse access to persons who register if the User cannot confirm that they are a registered business located on the island of Ireland.
Each account must be a personal account, with no reference to a trading name be it a sole trader, company or any other legal entity (whether incorporated or unincorporated).
Users cannot register for more than one account.
The information that Users supply in the public profile of their account must comply with Outsource2day profile policies.
Outsource2day reserve the right to restrict your access, temporarily or indefinitely block your account, warn other Buyers and Sellers of your actions or issue you a warning if:
Once a User account has been approved by Outsource2day and gone live, Users are solely responsible for any activity that occurs on their account, unless it is a result of actions beyond their control (such as hacking or if someone steals their password when they have taken reasonable steps to keep it secure). Users may never use another person’s user account or registration information for the Website.
3.1 Per Hour Rate / Fixed Price / Price per Item
The Seller’s payment for Projects are either agreed as per hour, fixed price or price per item rate for the Project.
On agreeing to engage with the Seller the Buyer agrees to transfer funds into a holding account managed by Outsource2day.
3.2 Scope of Delivery
The Buyer is required to provide details of their requirements to enable the Seller to draw up a service contract outlining the price, delivery timeframe and all other requirements associated with completing the Project prior to commencement of Project.
These requirements should include (but not be limited to):
Once the service contract has been agreed by both Buyer and Seller, Seller can commence work on project outside the realms of Outsource2day.
– The Seller agrees to provide regular progress updates.
– The Seller agrees to complete the Project within the delivery timescales indicated in service contract unless delays arise due to actions made by Buyer resulting in timescales been missed.
– If missing a previously agreed deadline is unavoidable then the Seller must inform the Buyer immediately and provide a revised delivery date.
– Failing to deliver the work within agreed timescales, or repeatedly revising previously agreed deadlines, may mean the Buyer requests a cancellation of the fixed priced Project and will be entitled to a refund of the funds they transferred in the holding account less any funds paid to the Seller that were previously authorised by Buyer.
– Late or non-delivery of Project will negatively affect the Seller’s rankings on Outsource2day.
– If the Buyer is not satisfied with the deliverables they must provide the Seller with detailed feedback on what work remains outstanding within a seven (7) day period from date of receipt of Project (or at agreed milestone reached). The Seller must provide, and be given the chance to provide, at least two revisions of the deliverables based on detailed feedback from the Buyer.
– Outsource2day recommends that a record of all direct communication between Buyer and Seller is kept by both parties in case of a Dispute.
When a Project is completed (or an agreed milestone has been reached) the Seller will inform Outsource2day so a request can be made to Buyer to authorise the release of funds on their behalf to the Seller held in the holding account managed by Outsource2day:
Once the Project has been completed and payment to Seller has been made in full, Outsource2day will contact Buyer requesting feedback for the Seller.
All Sellers on Outsource2day must strive to deliver a high standard of work, appropriately meeting their Buyer’s needs.
Specifically, Sellers must ensure that all deliverables are:
3.4 General Agreement between Buyer & Seller
The Buyer and Seller decide on the type of Project, Per Hour, custom or fixed price. They determine the terms and conditions of “Projects” including deliverables, any specific requirements, and for “Projects” the price, directly between them. The Buyer and Seller create a direct service contract between themselves and Outsource2day are not party to that contract (‘the Service Contract’).
Subject to this being varied as part of the Service Contract, ownership in and to any materials and or deliverables arising from a Project and any intellectual property rights therein, will be assigned to the Buyer upon successful payment to the Seller. If the Buyer and Seller wish to include any special terms of the contract (for example, in relation to the ownership of the work produced, ownership of intellectual property rights or special rights of termination), the Buyer and Seller should negotiate and document these terms in the Service Contract.
Subject to variation in the Service Contract, the terms and conditions of each Project shall be deemed to incorporate a term that in consideration of the fee paid for the Project the Seller thereby assigns to the Buyer absolutely with full title guarantee the following rights throughout the world:
In each case for the whole term including any renewals, reversions, revivals and extensions and together with all related rights and powers arising or accrued, including the right to bring, make, oppose, defend, appeal and obtain relief (and to retain any damages recovered) in respect of any infringement, or any other cause of action arising from ownership, of any of these assigned rights, whether occurring before, on, or after the date of Commencement of the Project.
Buyer & Seller promise that:
Payments are made as described in Section 3, for a Project agreed by the Buyer as successfully completed. The payment terms are five (5) days.
For Projects where no milestones have been agreed, the Seller must not request a release of funds from the holding account prior to Project completion; For Projects where milestones have been agreed, the Seller may request release of funds from the holding account as each milestone is reached and Buyer agrees to releasing funds. The purpose of funds being held in the holding account is to provide the Seller with the security needed for them to undertake the work.
All payments between Buyer and Seller must be processed through Outsource2day as described in Section 3, both for work sourced on Outsource2day and for any follow on work between the Buyer and Seller, either for the same Project or another Project.
Outsource2day aim to process these payments and credit funds to the Seller’s own bank in accordance with details provided by Seller at the time of becoming a member of Outsource2day within five (5) working days after receipt of confirmation from Buyer that funds may be released. However, Outsource2day reserve the right to take up to ten (10) working days. Once Outsource2day has processed payments, they are then subject to timescales imposed by the banking clearing system in the Republic of Ireland.
Payment (or attempt of) outside of Outsource2day is a breach of these terms and conditions unless the prior express written consent of Outsource2day has been obtained. Such payment (or attempt of) will lead to temporary and/ or permanent suspension of the Buyer and/ or Seller’s account. The Seller will be liable for any loss of business and legal expenses that Outsource2day may incur in recovering it. Outsource2day reserve the right to sanction funds held in the Seller’s Account in order to recover lost fees.
For security reasons, Outsource2day reserves the right to request additional information from Buyers and Sellers, including original documents, and to verify documents with issuing institutions. Therefore, we reserve the right to request the following proofs of identity:
– a copy of a Government issued ID (Passport, Driver’s License or National ID Card);
– a copy of a recent utility bill showing your name and address (less than 3 months old);
For credit/debit card users (one of the following):
– a copy of the front and back of the card used. For Security Compliance we recommend that you blank out the central 8 digits of the card number digits, and the last three digits from the number on the back;
– Credit or Debit Card Bank Statement of the card used on your Outsource2day Account (less than 3 months old). For Security Compliance you must blank out the central 8 digits of the card number digits;
For PayPal users:
– PayPal Account statement showing your PayPal registered name, email address and verification status along with any relevant transactions.
In using the holding account Outsource2day act, subject to these terms and conditions, on the User’s behalf. Outsource2day hold the funds in a separate holding account. Outsource2day is not a deposit taking body and any monies held by Outsource2day on a User’s behalf are not insured deposits. Users will not receive interest or other earnings on the funds in the holding account. Outsource2day will endeavour to ensure that the funds in the holding account are available to the User in accordance with these Terms and Conditions but do not guarantee that they will be available to the User in circumstances which are unforeseen or beyond our control.
If Outsource2day must return funds to the Buyer due to the Buyer (contrary to these Terms and Conditions) requesting a payment be reversed through its credit card provider, bank or Paypal then Outsource2day will be entitled to recover any costs/fees associated with returning funds from the Seller’s Outsource2day Account (and if insufficient monies are in the Seller’s Account), credit card or other previously made payment method if available.
To prevent funds being held indefinitely in the holding account, Outsource2day will notify the Seller in the event of funds being held for a Project requesting confirmation of one of the following:
– that the Project is still in progress
– that the Job has been completed
– that the Project was cancelled and to issue Buyer with a refund
– that the Project has been completed
If no action is taken by the Seller within five (5) days it will be assumed that the Project was not delivered by the Seller and the funds held in the holding account will be automatically refunded back to the Buyer.
Outsource2day uses third-party service provider Stripe to process Membership payments only. This third-party payment service provider is regulated and authorised to provide payment services in the countries where they operate. Outsource2day may share your personal or transactional information with a third-party payment service provider when it is necessary to process payments.
When the Project is completed and the Seller has been paid by the Buyer, both parties are asked to provide both qualitative feedback and a rating from 1-5 for the other party. This rating influences each User’s ranking on Outsource2day.
Both parties should complete the feedback honestly. Users must not falsify feedback, manipulate or coerce another User by threatening negative feedback or offer incentives in exchange for feedback. Any attempts of this nature should be reported immediately to Outsource2day.
Feedback comments that are reported to us as defamatory, abusive or offensive will be reviewed and may be removed at our discretion.
6.1 Cancellation of a Project
After the Commencement of a Project, the Buyer or Seller may request a cancellation:

6.2 Job Refund policy
A Buyer is entitled to receive a refund of funds held in the holding account less the costs/fees charged by financial institution under the following circumstances:
for per hour rate the Seller did not deliver the scope of work within the delivery timescales indicated in the agreed terms, or no time was spent on Project.
for fixed price Projects, non-delivery means agreed scope of work was not delivered within the agreed timescales;
Buyer and Seller may mutually agree to a refund for reasons other than the previous clause as defined in Section 6.2.1.
Refunds are only applicable to funds held in the holding account. As per Section 3, funds should only be paid out of the holding account once the Buyer is satisfied that the Project (or any agreed milestone deliverables) has been completed. By releasing funds from the holding account the Buyer accepts that this money is non-refundable.
Buyers must avoid filing a dispute or reversing payment through their credit card holder, Bank or PayPal. Attempts to seek a refund in this way will lead to the Buyer’s account being automatically suspended.
In case a Buyer is entitled to a refund, the Buyer receives the funds requested according to Section 6.2.1 minus a costs/fees charged by financial institution.
6.2.1 Requesting a refund
A Buyer can request a refund of the funds held in the holding account less the costs/fees charged by financial institution, and specifying a reason for their request:
Outsource2day will process approved (or non-actioned) refund requests back to the Buyer’s Account subject to a review of the refund reason and circumstances to ensure that both parties have complied with these terms and conditions, and that the purpose of the refund is not to avoid any of the parties’ obligations under these terms and conditions.
6.2.2 Refund and cancellation penalties
Users are strictly discouraged from causing cancellations and refunds. Refunds will impact Users standing in the Outsource2day marketplace as follows:
Outsource2day encourage both Sellers and Buyers to try and resolve any disagreements between themselves. Outsource2day is not liable for any disputes that may arise between Seller & Buyer as the service provided is outside the realm of Outsource2day platform. Outsource2day acts as a facilitating platform enabling Buyers to outsource Projects to Sellers who provide a service required to complete the Project.
Users agree and accept that Outsource2day acts in good faith and Users shall have no cause of action against Outsource2day (whether in contract, tort or otherwise). Users further agree and accept that they have no right to seek to hold Outsource2day liable for a Buyer or Seller’s alleged actions or failures.
8.1 Buyer Fees
Outsource2day do not charge a commission fee to the Buyer. Outsource2day do charge a membership fee to the Buyer to gain complete access to the database of Sellers registered with Outsource2day.
We withhold the right to add transaction fees in the future. These changes will be reflected in updated terms issued by us, which will apply to any transactions which take place after the updated fees come into force.
In case a Buyer is entitled to a refund according to Section 6.2, the Buyer receives the funds requested less the costs/fees charged by financial institution
8.2 Seller fees
For Sellers registered Outsource2day charges a Service Fee of a 10% (excl. VAT) on all work billed (earnings) up to €1,000 | 8% (excl. VAT) on all work billed (earnings) between €1,001 – €3,000 and 5% (excl. VAT) on all work billed (earnings) over €3,000 capped at a maximum Service Fee of €500.
All Users are provided with a statement at the end of each month showing their net effective commission fee.
Bank transfer reversal fees – If your bank transfer gets reversed due to incorrect banking information, wrong bank account type or foreign currency bank account settings limitation, you will be charged a reversal fee as well as the currency exchange difference (if applicable) not to exceed the amount charged by the banking institute.
The Outsource2day terms of website use define how Users may make use of Outsource2day whether as a guest or a registered user. They contain the heavy but important stuff so please read them carefully.
These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the Republic of Ireland. The courts of the Republic of Ireland shall have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).

‘Buyer’ means a person buying services from a Seller on Outsource2day;
‘Commencement of the Job’ means acceptance of a Proposal for a Custom Job by the Buyer
‘Content’ means such things as data, text, photographs, videos, audio clips, written posts and comments, graphics, User content and interactive features generated, provided, or otherwise made accessible on or through Outsource2day;
‘Custom Job’ is a piece of work that commences with the acceptance of a Proposal by a Buyer or the acceptance of a Hire request by a Seller. This work is agreed after the Buyer has posted a request on Outsource2day or in direct communication between a Buyer and a Seller. A Custom Job can also be agreed as a follow on piece of work.
‘Guest’ means an unregistered user of Outsource2day
‘holding account’ means the account where money is deposited on commencement of the Project and is only released in accordance with these terms and conditions;
‘Invoice’ means a bill for a completed Project which is raised by Outsource2day on behalf of the Seller;
‘Project’ means a piece of work that a Seller and Buyer agree via Outsource2day is to be provided by the Seller to the Buyer. Project refers to work either agreed when a Proposal by a Seller is accepted by the Buyer.
‘Outsource2day’ means the website with the domain name www.outsource2day.com or Outsource2day Limited as the context so requires;
‘Proposal’ means an offer made by a Seller to a Buyer to provide a Custom Job and which must contain a fee quotation;
‘Seller’ means a person selling services to a Buyer via Outsource2day;
‘User’ means any registered person who uses Outsource2day;
‘User Content’ means all Content uploaded, submitted, distributed, or posted to the services by Users, including without limitation, Proposals and communication via Messenger option. User Content does not include any materials or deliverables, or intellectual property therein arising from a Project, which shall be assigned to the Buyer on successful payment for the Project. User Content is the sole responsibility of the person who originated it;
